1. Overview

These Terms of Service ("Terms") govern your access to and use of the products and services provided through The Rational Move™ platform, including the Costa Rica Fit Test and Decision Plan 90™ (collectively, the "Services").

The Services are owned and operated by Orion Way LLC, a limited liability company registered in Wyoming, United States ("Company," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Nature of Services

The Rational Move™ provides structured analytical tools designed to help individuals evaluate relocation-related decisions. The Costa Rica Fit Test is a self-assessment that produces a scored evaluation across multiple dimensions. Decision Plan 90™ is a guided 90-day planning framework that helps users work through identified areas of friction.

All outputs, scores, interpretations, and recommendations generated by the Services are analytical in nature. They are intended to support your own decision-making process by organizing information and surfacing patterns.

3. No Professional Advice

The Services do not constitute and shall not be construed as legal, tax, financial, immigration, medical, or any other form of professional advice. The Company is not a law firm, accounting firm, financial advisory firm, medical provider, or immigration consultancy.

You should consult qualified professionals in the relevant jurisdictions before making any decisions based on or related to the outputs of the Services. The Company expressly disclaims any responsibility for decisions made on the basis of information provided through the Services.

4. User Responsibility

You acknowledge and agree that all decisions arising from your use of the Services are your sole responsibility. The Services provide a structured framework for self-evaluation, but the final decision to relocate, invest, change employment, or take any other action rests entirely with you.

You are responsible for verifying the accuracy and applicability of any information provided through the Services to your specific circumstances.

5. Accounts and Access

Access to certain features of the Services may require providing an email address or completing a purchase. You agree to provide accurate information and to keep your access credentials secure. You are responsible for all activity that occurs under your account or access link.

6. Payments and Billing

Certain Services, including Decision Plan 90™, require payment. All payments are processed through third-party payment providers and are billed by Orion Way LLC. Prices are displayed at the time of purchase and are subject to change without prior notice.

All sales are final unless otherwise required by applicable law. Refund requests may be considered on a case-by-case basis at the sole discretion of the Company.

7. Intellectual Property

All content, materials, designs, methodologies, scoring frameworks, text, graphics, logos, and software associated with The Rational Move™, the Costa Rica Fit Test, and Decision Plan 90™ are the exclusive property of Orion Way LLC or its licensors and are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any portion of the Services without prior written consent from the Company.

8. Privacy and Data

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the collection and use of information as described therein. We do not sell your personal data to third parties.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Orion Way LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, including but not limited to loss of profits, data, or goodwill.

The Company's total aggregate liability for any claims arising from or related to the Services shall not exceed the amount you paid to the Company in the twelve (12) months preceding the event giving rise to the claim.

10. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

The Company does not warrant that the Services will be uninterrupted, error-free, or that any results obtained from the Services will be accurate or reliable.

11. Indemnification

You agree to indemnify, defend, and hold harmless Orion Way LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Services or your violation of these Terms.

12. Modifications to Terms

The Company reserves the right to modify these Terms at any time. Changes will be effective upon posting to the platform. Your continued use of the Services after any modifications constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Wyoming.
